Platform
3.1 You may use the Platform only for lawful purposes. You must not use the Platform:
- if you are under the age of 18 unless, if you are a Client, the Practitioner has obtained the consent of your parent or guardian to provide Services to you;
- in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
- for the purpose of harming or attempting to harm minors in any way;
- to send, knowingly receive, upload, download, use or re-use any material which does not comply with the content standards contained within these Terms of Platform Use;
- to interfere with any other User’s use or enjoyment of the Platform;
- to attempt to clinically diagnose yourself; or
- to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
3.2 You also agree:
- Not to reproduce, duplicate, copy or re-sell any part of the Platform in contravention of the provisions of our Terms of Platform use; and
- Not to access without authority, interfere with, damage or disrupt;
- any part of the Platform;
- any equipment or network on which the Platform is used;
- any software used in the provision of the Platform; or
- any equipment or network or software owned or used by any third party.
Content Standards
3.3 These content standards apply to any and all material which you contribute to the Platform (“Contributions”).
3.4 You must comply with the spirit and the letter of the content standards outlined in these Terms of Platform Use. The standards apply to each part of any Contribution as well as to its whole.
3.5 Contributions must:
- be accurate (where they state facts or detail the nature and severity of your physical condition);
- be genuinely held (where they state opinions); and
- comply with applicable law in the UK and in any country from which they are posted.
3.6 Contributions must not:
- contain any material which is defamatory of any person;
- contain any material which is obscene, offensive, hateful or inflammatory;
- promote sexually explicit material;
- promote violence;
- promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
- infringe any copyright, database right or trademark of any other person;
- be likely to deceive any person;
- be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence;
- promote any illegal activity;
- be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety;
- be likely to harass, upset, embarrass, alarm or annoy any other person;
- be used to impersonate any person, or to misrepresent your identity or affiliation with any person;
- give the impression that they emanate from us, if this is not the case; or
- advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.
Reporting and Enforcement
3.7 If you find any content on our Platform to be in any way offensive, obscene, defamatory, racist, harmful, inaccurate, unlawful, illegal, infringing of any third-party rights, deceptive in any way or otherwise in breach of our content standards, please notify us by email at support@bigpicturemedical.com and using the subject heading “Unacceptable Content”. We take complaints seriously and on receipt of your complaint we will investigate whether the content breaches our content standards or this clause 3 and may at our discretion, remove or block access to the Content complained of.
Messaging Feature Standards
3.8 The BPM Platform provides a messaging feature that is intended to facilitate communication between patients and their healthcare providers for the purpose of supporting patient care and well-being. To ensure the safe and secure use of this feature, the following acceptable use statements should be noted;
3.9 Permitted Uses:
- Users may utilise the messaging feature for non-urgent healthcare-related communications, including, but not limited to:
- Routine inquiries about health conditions.
- Requests for clarification regarding treatment plans or medications.
- Scheduling or rescheduling non-urgent appointments.
- Follow-up questions after appointments.
- Sharing updates and information relevant to their ongoing care.
3.10 Prohibited Uses:
Users are strictly prohibited from using the messaging feature for any of the following:
- Emergencies: The messaging feature is not designed for urgent medical needs or emergency situations. In the event of a medical emergency, users must immediately dial emergency services or seek immediate in-person medical attention.
- Unlawful Activity: Any communication that violates any applicable law, regulation, or ordinance is strictly prohibited.
- Harassment and Abuse: Users shall not use the messaging feature to transmit any content that is defamatory, libelous, harassing, abusive, threatening, offensive, discriminatory, or otherwise objectionable.
- Solicitation and Advertising: The transmission of unsolicited commercial messages, advertisements, or promotional materials is prohibited.
- Sharing of Sensitive Information: Users should exercise caution when transmitting sensitive personal information and should avoid sharing information that is not directly relevant to their healthcare.
- Misrepresentation: Users must not misrepresent their identity or provide false or misleading information.
- Circumventing Security: Users must not attempt to circumvent or disable any security or technological measure implemented within the messaging feature.
- High Volume of Messages: Users must not use the messaging feature to send an excessive volume of messages that could hinder your healthcare provider’s ability to provide service.
3.11 Response Times:
While your healthcare provider will strive to respond to messages in a timely manner, the platform does not guarantee specific response times. Users acknowledge that response times may vary depending on the nature of the enquiry, provider availability, and other factors.
3.12 Monitoring and Enforcement:
Your healthcare provider reserves the right to monitor communications within the messaging feature to ensure compliance with these Terms of Service and to protect the integrity of the platform. Your healthcare provider may take appropriate action, including, but not limited to, suspending or terminating a user’s access to the messaging feature, if it determines that a user has violated these terms.
3.13 Message Retention:
Your healthcare provider may establish policies regarding the retention and deletion of messages transmitted through the messaging feature. Users should refer to the platform’s Privacy Policy for further information about data retention practices.
Suspension & Termination
3.14 We will determine, in our discretion, whether there has been a breach of these Terms of Platform Use through your use of the Platform. Where a breach has occurred, we may take such action as we deem appropriate.
3.15 Failure to comply with this clause 3 constitutes a material breach of the Terms of Platform Use upon which you are permitted to use the Platform, and may result in our taking all or any of the following actions:
- immediate, temporary or permanent withdrawal of your right to use the Platform;
- immediate, temporary or permanent removal of any posting or material uploaded by you to the Platform;
- issue of a warning to you;
- legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;
- further legal action against you; and/or
- disclosure of such information to law enforcement authorities as we reasonably feel is necessary.
3.16 We exclude liability for actions taken in response to breaches of this clause 3. The responses described in this policy are not limited, and we may take any other action we reasonably deem appropriate.
